Are you a legitimate company?

Yes, we are an established real estate acquisitions firm with extensive experience investing in vacant land. As one of the largest land holding companies in Bella Vista, Arkansas, we have a proven track record in the region and are actively seeking to expand our portfolio of properties in this area.


Is this transaction safe and secure?

Yes; we’ve designed our process with your security and peace of mind as top priorities. After receiving your signed purchase agreement, we immediately transfer the closing process to a reputable local title company. This independent third party professionally manages all closing and payment details, ensuring a transparent and protected transaction from start to finish.


Are there any hidden costs or fees?

Never. The amount we offer is what you’ll receive at closing. We cover all closing costs, title fees, mobile notary expenses, and even any back-due property taxes. The single exception would be if your property has existing liens (beyond property taxes) that need to be resolved.


What makes you different from a real estate agent?

We are direct buyers who eliminate the middleman. We close within just two weeks and our straightforward offers come with no contingencies or commissions – you receive the full offer price at closing. With real estate agents, your property might sit on the market for months awaiting an offer. Those offers typically come with contingencies on surveys and soil tests, often requiring you to split these costs with potential buyers. Closing costs are usually divided between parties as well. Furthermore, when listing with an agent, you’re locked into a binding contract for a set period, obligating you to pay their commission regardless of how the property sells – even if you find the buyer yourself.


I live out-of-state, do I need to come to Bella Vista to sell my property?

No. We’ve streamlined the process to make selling your property as hassle-free as possible, regardless of where you currently reside. For your convenience, the title company will arrange for a mobile notary to meet with you at the time and location of your choosing to sign all closing documents.


How do I receive my payment?

Once closing is complete, you’ll receive your funds directly from the title company – either through a cashier’s check or wire transfer, depending on your preference.

My property requires probate work. Can you assist with this?

I own other properties too. Will you consider buying them as well?

While our primary focus is Northwest Arkansas, we’re open to purchasing vacant land throughout the country. Simply share the property details with us, and we’ll promptly provide you with a fair offer.


I don’t want to lose my Bella Vista membership benefits. Can I still accept your offer?

We own multiple “membership” lots in Bella Vista. If you are interested in selling your land to us but do not want to lose your POA benefits, just let us know and we can discuss further.


I lost my original property deed. Is that an issue?

Not at all! We don’t require your original deed for the transaction. The county maintains electronic records of all property deeds, and the title company will access these official records during the title search process. If you happen to find your original deed, please keep it for your records—there’s no need to send it to us or the title company.


What are title defects and encumbrances? How do I know if my title is clear to sell?

Title defects are issues or inaccuracies in a property/s ownership history. Some of the more common defects that we have encountered are errors in property owner names and omitted marital statuses on deeds. While these issues can often be resolved with relative ease, the process becomes more complex when the individuals named on the deed are deceased. When property owners have passed away and (potentially) require probate proceedings, this creates another layer of title complications that must be addressed. Title encumbrances include liens, outstanding debts, and legal judgments filed against the property owner.

Before closing, the title company conducts a comprehensive title search, carefully examining the ownership history to verify the title is clear and that all legal owners are properly identified to sign the closing documents.


What if my title is found to have defects?

Around 5-10% of the properties we acquire have title defects that require resolution. If your title is found to have defects, we can extend our purchase agreement giving you the necessary time to address these matters. Title defects vary greatly in complexity and are handled case-by-case; sometimes it’s as straightforward as filing a death certificate that you already have on-hand, while other situations may require locating previous owners or completing probate procedures. We have worked with property owners who have been able to clear their defects quickly without delaying closing, and we’ve also worked with those needing several months to solve more complex title challenges. At Fortney Land Holdings, we’re committed to closing on your schedule; we’ll wait patiently while you clear the issues and offer assistance throughout the process.

Alternatively, if resolving title defects seems overwhelming, we can mutually terminate our contract. However, it’s important to understand that if your title contains defects, any future buyer will encounter the same obstacles.
